Rental Agreement

Effective date: August 17, 2026

This Rental Agreement (“Agreement”) is between The Wedding Arch Co. (“Company,” “we,” or “us”) and the customer identified on the associated order (“Customer” or “you”). By checking the agreement box, submitting payment, or accepting possession of rental property, the Customer agrees to these terms.

1. Rental items

We agree to rent the items listed in the Customer’s order confirmation, including any wedding arches, easels, chalkboards, artificial floral arrangements, draping, accent arches, or other accessories. Photographs represent the general appearance of each item. Because pieces may be handmade, natural wood, or individually styled, minor variations in color, texture, dimensions, and appearance may occur.

2. Rental period

Rental dates and the agreed pickup, delivery, and return arrangements appear on the booking confirmation. Unless otherwise stated in writing, rental prices cover one wedding or event weekend. Keeping items beyond the agreed return time requires prior approval.

A late-return fee of $25 per calendar day may be charged for items returned late. If an item is not returned and the Customer cannot be reached, it may be considered lost and the Customer may be charged its replacement cost.

3. Payment

Full payment is required when the reservation is placed. A reservation is not confirmed until payment has been successfully processed and the Customer receives an order confirmation. We do not charge a separate refundable security deposit. Optional add-ons are charged once per rental period unless checkout expressly states otherwise.

4. Pickup and delivery

Free pickup is available from the designated central Montgomery pickup location. The exact location and confirmed time will be provided by email. Delivery and retrieval are available for the fee displayed during checkout.

Delivery does not include setup, decorating, venue fees, difficult access, stairs, or unusual handling unless expressly included in the order or separately confirmed in writing. The Customer must provide accurate venue information and ensure safe access. Any additional charge caused by inaccurate information, inaccessible conditions, excessive waiting, or a requested change will be disclosed and approved before the additional service is performed.

5. Scheduling

The Customer must provide a preferred pickup or delivery time when booking. Requested times are not guaranteed until confirmed by the Company. Customers should book at least four days before the event. Short-notice requests may be declined or may require a separately disclosed rush fee. Custom-built pieces and special arrangements require written confirmation and may involve additional charges.

6. Inspection and acceptance

The Customer should inspect all items when received. Existing damage, missing pieces, or problems must be reported promptly and, when possible, documented with photographs before use. If no issue is reported before use, the items will be considered received in acceptable condition.

7. Care and permitted use

Rental items must be used only for their intended decorative purpose. The Customer agrees to:

  • Keep items away from flames, candles, excessive heat, standing water, mud, and damaging substances.
  • Prevent guests from climbing, sitting, leaning, or hanging on arches, easels, and displays.
  • Follow all assembly, anchoring, and safety instructions.
  • Supervise children and animals near rental items.
  • Obtain permission before using nails, screws, staples, permanent adhesives, or materials that may stain or damage an item.
  • Not move delivered or assembled items without permission when doing so could cause damage or injury.

Artificial flowers and draping must be returned with the rented structure unless otherwise stated.

8. Outdoor use and weather

The Customer accepts the risks associated with outdoor use. Arches and displays must be properly secured and should not be used during unsafe wind, lightning, severe rain, or other hazardous conditions. We may decline or discontinue delivery, setup, or outdoor use when conditions create a reasonable safety risk. The Customer is responsible for monitoring conditions during the event and discontinuing use when necessary.

The Customer remains responsible for damage caused by wind, rain, mud, sprinklers, severe weather, or failure to secure an item properly while it is in the Customer’s possession.

9. Damage, loss, and cleaning

The Customer is responsible for the rented property from pickup or delivery until return or retrieval. Normal wear will not result in a charge. The Customer may be invoiced for reasonable cleaning, repair, or replacement costs resulting from missing or stolen items; breakage; structural, water, weather, or fire damage; stains, wax, paint, permanent adhesives, or excessive dirt; improper assembly, transportation, or storage; unauthorized alterations; or negligent or prohibited use.

We will provide documentation of the damage and the amount claimed. Any post-rental charge will be invoiced separately and will not be automatically charged as a security deposit.

10. Cancellation and rescheduling

  • At least 14 days before the event: full refund.
  • 7–13 days before the event: 50% refund.
  • Fewer than 7 days before the event: no refund.
  • Approved rescheduling: payment may be transferred once to another available date within 12 months.

Custom-built or specially purchased items may be nonrefundable once work or purchasing has begun, provided this is disclosed and accepted in writing. Weather concerns do not automatically cancel a reservation. Contact us promptly to discuss rescheduling or safe alternatives.

11. Venue requirements

The Customer is responsible for obtaining venue permission and complying with venue rules. We are not responsible for delays, denied access, venue restrictions, sprinkler systems, uneven ground, inadequate space, or venue-imposed fees.

12. Safety and responsibility

The Customer is responsible for supervising rental items during the rental period and assumes responsibility for injuries or property damage caused by misuse, unauthorized movement, improper assembly, failure to follow instructions, or unsafe conditions under the Customer’s control. We remain responsible for losses directly caused by our own negligence to the extent required by Alabama law.

13. Limitation of liability

To the extent permitted by law, the Company’s liability arising from a rental will not exceed the amount paid for that rental, except where a greater remedy is required by law. We are not responsible for indirect losses such as lost venue time, lost profits, photography expenses, emotional distress, or event-postponement costs when a delay or failure results from circumstances reasonably beyond our control.

14. Events beyond reasonable control

Neither party will be considered in breach for delays caused by severe weather, natural disasters, road closures, government restrictions, serious illness, accidents, or other circumstances that could not reasonably have been prevented. Both parties will make a good-faith effort to reschedule or find a reasonable alternative.

15. Communication

The Customer authorizes us to use the email address and telephone number submitted with the order for booking, scheduling, delivery, pickup, safety, and other order-related communications. Marketing text messages will not be sent without any consent required by law.

16. Governing law

This Agreement is governed by the laws of the State of Alabama. Any dispute will be handled in an appropriate court located in Montgomery County, Alabama, unless applicable law requires otherwise.

17. Entire agreement

The order confirmation, this Agreement, and any written changes accepted by both parties constitute the complete agreement. If one provision is unenforceable, the remaining provisions continue to apply. Changes must be confirmed in writing.

18. Electronic acceptance

By checking the rental-agreement box and placing the order, the Customer confirms that they are at least 18 years old and authorized to enter this Agreement; have reviewed the selected items, prices, and rental dates; understand the pickup, delivery, cancellation, late-return, and damage terms; and agree to be bound by this Agreement.

19. Additional setup and safety requirements

Before each use, the Customer must inspect the rental items, connections, fasteners, bases, and supports. An item must not be used if it appears loose, damaged, incomplete, unstable, or unsafe. The Customer must stop using the item, keep guests away, and contact the Company promptly if a safety concern develops.

  • Assembly, disassembly, repositioning, and lifting must be performed by at least two capable adults unless the Company provides different written instructions.
  • Items must be placed on a firm, level surface and secured using the anchoring method and instructions provided by the Company. Customer-provided substitutions or improvised anchoring must not be used without written approval.
  • Nothing may be suspended from an arch or display except lightweight decorations intended for that item. People must not climb, pull, push, swing from, or lean against rental items.
  • Rental items must be kept away from aisles, exits, vehicle paths, open flames, heaters, sprinklers, electrical hazards, and other conditions likely to cause injury or damage.
  • For outdoor use, the Customer must monitor weather throughout the rental period and immediately discontinue use if an item sways, shifts, loosens, becomes unstable, or if wind, lightning, heavy rain, or another hazardous condition develops.
  • The Customer is responsible for communicating these restrictions to the venue, decorators, vendors, guests, and anyone who assembles, moves, decorates, or supervises the rental items.

Acceptance of the rental items confirms that the Customer has had an opportunity to inspect them, has received or can request setup and safety instructions, and agrees not to use any item in a condition or manner the Customer reasonably believes is unsafe.
